&#8220;foreclosure action.&#8221; The problem? The media often misinterprets this and reports the total as actual foreclosures, creating a distorted picture of market distress.<\/h3>\n<h3 data-start=\"267\" data-end=\"317\"><strong data-start=\"274\" data-end=\"317\">How ATTOM Captures Foreclosure Activity<\/strong><\/h3>\n<p data-start=\"319\" data-end=\"412\">ATTOM defines \u201cforeclosure activity\u201d to include <strong data-start=\"367\" data-end=\"411\">any of the following three legal notices<\/strong>:<\/p>\n<ol data-start=\"413\" data-end=\"689\">\n<li data-start=\"413\" data-end=\"507\">\n<p data-start=\"416\" data-end=\"507\"><strong data-start=\"416\" data-end=\"443\">Notice of Default (NOD)<\/strong> \u2013 The first step in the foreclosure process in judicial states.<\/p>\n<\/li>\n<li data-start=\"508\" data-end=\"600\">\n<p data-start=\"511\" data-end=\"600\"><strong data-start=\"511\" data-end=\"543\">Notice of Trustee Sale (NTS)<\/strong> or <strong data-start=\"547\" data-end=\"567\">Lis Pendens (LP)<\/strong> \u2013 Public notice of legal action.<\/p>\n<\/li>\n<li data-start=\"601\" data-end=\"689\">\n<p data-start=\"604\" data-end=\"689\"><strong data-start=\"604\" data-end=\"631\">Real Estate Owned (REO)<\/strong> \u2013 When the lender has taken possession after the auction.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"691\" data-end=\"761\">Each of these steps is logged as <strong data-start=\"724\" data-end=\"760\">an individual foreclosure action<\/strong>.<\/p>\n<hr data-start=\"763\" data-end=\"766\" \/>\n<h3 data-start=\"768\" data-end=\"837\">&#x26a0;&#xfe0f; <strong data-start=\"775\" data-end=\"837\">The Problem: One Property = Multiple Foreclosure \u201cActions\u201d<\/strong><\/h3>\n<p data-start=\"839\" data-end=\"880\">Let\u2019s say a single property goes through:<\/p>\n<ul data-start=\"881\" data-end=\"990\">\n<li data-start=\"881\" data-end=\"919\">\n<p data-start=\"883\" data-end=\"919\">A <strong data-start=\"885\" data-end=\"906\">Lis Pendens filed<\/strong> in January<\/p>\n<\/li>\n<li data-start=\"920\" data-end=\"960\">\n<p data-start=\"922\" data-end=\"960\">A <strong data-start=\"924\" data-end=\"942\">Notice of Sale<\/strong> issued in March<\/p>\n<\/li>\n<li data-start=\"961\" data-end=\"990\">\n<p data-start=\"963\" data-end=\"990\">It becomes <strong data-start=\"974\" data-end=\"981\">REO<\/strong> in May<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"992\" data-end=\"1093\">ATTOM would log that as <strong data-start=\"1016\" data-end=\"1050\">3 separate foreclosure actions<\/strong>\u2014even though it\u2019s <strong data-start=\"1068\" data-end=\"1092\">one foreclosure case<\/strong>.<\/p>\n<hr data-start=\"1095\" data-end=\"1098\" \/>\n<h3 data-start=\"1100\" data-end=\"1134\"><strong data-start=\"1107\" data-end=\"1134\">How This Skews the Data<\/strong><\/h3>\n<ul data-start=\"1136\" data-end=\"1571\">\n<li data-start=\"1136\" data-end=\"1183\">\n<p data-start=\"1138\"
