Breiterman Jurado Associates: Supporting columns 1\/2 the required load\u2013 i.e. too small.<\/li>\n<\/ul>\n<h2>Surfside \u2013 Collapse of the Condo Market or Prime Opportunity: FL CONDO 2019 STATISTICS<\/h2>\n<ul>\n<li>Approximately ~ 1.5 million Condos &#8211; 61% (over 900k) are already 30+ years old.<\/li>\n<li>About 10% of all FL Residents live in 30-year-old Condos \u2013 aging with structural problems.<\/li>\n<li>Almost 40% are located in Miami-Dade\/Broward \u2013 particularly susceptible due to hurricanes<\/li>\n<li>Half of condo associations have inadequate financial reserves\/ waived entirely.<\/li>\n<\/ul>\n<h2>GOV. DESANTIS &amp; THE LEGISLATURE \u2013 SB 4D (2022) and SB 154 (2023) (the \u201cBand-Aid bill\u201d)<br \/>\nBill, while it has many parts \u2013 but will focus on the 2 Main Portions: CAN BE DESCRIBED IN 2 MAIN PORTIONS \u2013 SIRS and MILESTONE INSPECTIONS. these 2 required for any condo over 3 stories tall.<\/h2>\n<h2>MILESTONE INSPECTIONS \u2013<\/h2>\n<p>Mandatory performed by Dec 31st in the year the condo reaches the 30th year<\/p>\n<ul>\n<li>Roof \/Waterproofing\/Exterior Painting<\/li>\n<li>Load-bearing walls\/structural members o Windows &amp;amp; Exterior Doors<\/li>\n<\/ul>\n<p>County records shall serve as the date. Time period may be accelerated for aggravated<br \/>\ncircumstances by the local enforcement agency.<\/p>\n<h2>Phase 1 and Phase 2<\/h2>\n<h3>Phase 1 Inspection<\/h3>\n<ul>\n<li>Licensed engineer\/architect or team<\/li>\n<li>Visual Qualitative Inspection of habitable\/non-habitable areas including major structural<br \/>\ncomponents and provide an analysis of structural integrity.<\/li>\n<li>\u201cSubstantial Structural Deterioration\u201d &#8211; distress or substantial structural weakness negatively<br \/>\naffecting the general structural condition and integrity of the building\u00a0&#8211; NOT \u201csurface<br \/>\nimperfections\u201d like cracks, distortion, sagging, deflections, signs of leakage, or peeling finishes;<\/li>\n<li>Unless such Phase 1 or Phase 2 inspector finds that those \u201csurface imperfections\u201d are signs of<br \/>\n\u201csubstantial structural deterioration\u201d.<\/li>\n<li>If any issues are raised, go to Phase 2.<\/li>\n<\/ul>\n<h3>Phase 2 Inspection \u2013<\/h3>\n<ul>\n<li>Any issues identified in Phase 1 must be under destructive\/non-destructive testing<\/li>\n<li>Recommend a program for fully assessing and repairing distressed and damaged portions<\/li>\n<\/ul>\n<h3>\u201cSIRS\u201d &#8211; review of reserve funds<\/h3>\n<ul>\n<li>for any condo over 3 stories tall + Condos, 1 addressing ALL major repairs and replacements 2 to<br \/>\ncommon elements.<\/li>\n<li>SIRS must include the following items\/categories:<\/li>\n<li>Roof o Waterproofing\/Exterior Painting<\/li>\n<li>Load-bearing walls\/structural members o Windows &amp;amp; Exterior Doors<\/li>\n<li>Fireproofing\/fire protection systems o Any other item &amp;gt; $10k deferred maint.<br \/>\nor replacement \u2013 if failed would negatively affect the above.<\/p>\n<ul>\n<li>Electrical<\/li>\n<li>Plumbing<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2>Effective 12\/31\/24 &#8211; Cannot WAIVE and cannot POOL\/DESCRIBE ROOF: Condo associations must have budgets updated to match SIRS by 2025<\/h2>\n<h3>Surfside \u2013 Collapse of the Condo Market or Prime Opportunity: MILESTONE PROCEDURE<\/h3>\n<ul>\n<li>Self-report DBPR Div. Cost &#8211; $25 million. If fully sold = $1.3B. *(New $\/SqFt = ~$3,800 per SqFt) 3<\/li>\n<li>Compare this to the Sale \u2013 Immediately before the collapse:<\/li>\n<li>3Bd\/2Ba &#8211; 1,748sq\/ft \u2013 SOLD 6\/16\/21 &#8211; $710k ($406\/SqFt)<\/li>\n<li>2Bd\/2Ba \u2013 1,683sq\/ft \u2013 SOLD 2\/28\/21 &#8211; $800k ($475\/SqFt)<\/li>\n<\/ul>\n<h2>Developers\u2019 Opportunity \u2013 Reports are coming in about developers buying up the aging waterfront<\/h2>\n<ol>\n<li>Only residential condo and co-ops, not including non-residential (i.e. office) greater than 3 stories &amp;amp; residential portions of mixed use hi-rise.<\/li>\n<li>Not including elements that have a life expectancy of over 25 yrs \u2013 but recommendations may be made.<\/li>\n<li>WRLN- Miami (<a href=\"https:\/\/www.wlrn.org\/south-florida\/2023-09-11\/surfside-condo-collapse-memorial-garbage\">https:\/\/www.wlrn.org\/south-florida\/2023-09-11\/surfside-condo-collapse-memorial-garbage<\/a>)<\/li>\n<\/ol>\n<p>Assessments \u2013 Lien \u2013 then Foreclosure \u2013 could cause a soft market where there isn\u2019t the market for a teardown and where owners can\u2019t pay their assessments.<\/p>\n<ul>\n<li>Fixed Income<\/li>\n<li>Many Don\u2019t have a Mortgage<\/li>\n<li>THEREFORE inability to pay large lump-sum assessments and foreclosure wave that may<br \/>\nresult.<\/li>\n<\/ul>\n<h2>Doom Gloom ??? \u2013 possibly<\/h2>\n<h3>In Addition, there are Other Factors\/options:<\/h3>\n<ul>\n<li>Hurricane Ian Effects \u2013 Many are already tapped out.<\/li>\n<li>Increased Insurance \u2013 Some COAs are seeing rates rise as much as 50% to 10x.<\/li>\n<li>Financing on Expected Assessment Income \u2013 creative lending to finance immediate repairs.<\/li>\n<\/ul>\n<h3>A NOTE ON CONDO TERMINATIONS<\/h3>\n<ul>\n<li>Termination \u2013 80% Approval, 5% can block, and 24mo. waiting period btw plan votes.<\/li>\n<li>Economic Waste \u2013 The cost to rebuild is greater than the total value. Lack of case law on the topic.<\/li>\n<\/ul>\n<h3>Buying \/ Selling:<\/h3>\n<ul>\n<li>SIRS must be kept on file with the COAs for at least 15 yrs after completion.<\/li>\n<li>Unit Owners AND their representatives can inspect\/review; so can renters.<\/li>\n<li>Estoppels and Review of reserve accounts \u2013 since Seller has access \u2013 make this a contingency.<\/li>\n<\/ul>\n<h3>Association Budget, year-end assessment; Common Area Insurance, Board Minutes<br \/>\nConclusion: May take 4 or 5 years to see the knock-on effects fully play out.<\/h3>\n<ul>\n<li>Probably will push prices higher overall.<\/li>\n<li>Credentialed professionals making the reports.<\/li>\n<li>\u201cUseful Life Calculations\u201d &#8211; keeping current and updated; inflation, current price data.<\/li>\n<li>Are the reserves kept up \u2013 i.e. has COA kept to the budget?<\/li>\n<\/ul>\n<h2><strong>\u00a0<\/strong><strong>Dylan R.
